1. Agreement
These Terms govern your use of getorqai.com and the Orq AI platform (the "Service"), operated by Orq AI B.V. ("the Company," "we," "us," or "our") (Blaak 40, Floor 8, 3011 AA Rotterdam, Netherlands). By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.
If you are a consumer - a natural person acting outside your trade, business, craft, or profession - nothing in these Terms limits your statutory consumer rights under the law of your country of residence.
The Service is an AI agent observability and evaluation platform. It provides execution tracing for LLM-based agents, rubric-based eval suites, and release gating that can block deploys when eval scores regress. It is built for engineering teams shipping AI agent features to production.
2. Accounts and Access
- You must be at least 18 years old, or have parental consent, to create an account.
- You are responsible for keeping your account credentials and API keys confidential. You must notify us promptly at [email protected] if you suspect unauthorised access.
- One Free plan account per organisation. Circumventing plan limits by creating multiple accounts is a breach of these Terms.
3. Acceptable Use
- You agree not to use the Service for unlawful purposes or in a way that violates applicable law.
- You agree not to interfere with or disrupt the integrity or performance of the Service or its infrastructure.
- You agree not to attempt to gain unauthorised access to any part of the Service, other accounts, or related systems.
- You may not copy, scrape, reverse-engineer, or create derivative works from the Service except as expressly permitted by mandatory law or these Terms.
- You are solely responsible for the agent instrumentation code you deploy and for the trace content your agents submit to Orq AI. Orq AI is not liable for the content, accuracy, or legality of trace payloads submitted by customers.
4. Intellectual Property
The Service, including the platform, dashboard, documentation, and all software, is owned by the Company or its licensors and is protected by EU and international intellectual-property law. You receive a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during the term of your account.
Customer-submitted trace data, eval definitions, and release gate configurations remain the intellectual property of the customer. You grant the Company a limited licence to store, process, and display this content solely to provide the Service to your account.
5. Data Processing
Personal data you provide as an account holder is processed as described in our Privacy Policy. For trace content submitted through the SDK, where you are the data controller and the Company acts as your data processor, a data-processing agreement governs those terms. Trace retention periods vary by plan: 7 days on Free, 30 days on Pro, and custom periods on Scale. You are responsible for ensuring that trace content you submit complies with your own obligations to your end users under applicable data-protection law.
6. Right of Withdrawal (Consumer Contracts)
Where you enter into a paid subscription with the Company as a consumer at distance, you have the right to withdraw within 14 days under the EU Consumer Rights Directive without giving any reason. To exercise this right, contact us at [email protected] with a clear statement of withdrawal. We will refund any payments received within 14 days of receiving your withdrawal notice.
The Free plan as currently offered through getorqai.com does not involve a paid contract. This clause applies to paid plans (Pro, Scale) if entered as a consumer.
7. Disclaimers and Statutory Guarantees
The Service is provided on an "as is" basis. Nothing in these Terms excludes or limits our liability for (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded under mandatory law. Statutory guarantees that apply to consumers under EU law are not affected by these Terms.
The Company does not warrant that the Service will be available without interruption or that evaluation scores will detect all possible quality regressions in your agent. Eval suite effectiveness depends on the quality of the rubrics and test corpus you configure.
8. Limitation of Liability
To the extent permitted by law, the Company's total liability for any claim arising from or related to the Service will not exceed the fees paid by you to the Company in the three months preceding the event giving rise to the claim, or EUR 100, whichever is greater. This cap does not apply to liability that cannot be limited under mandatory law (see Section 7).
9. Termination
You may close your account at any time by contacting [email protected]. We may suspend or terminate your access for material breach of these Terms, after giving reasonable notice where practicable. On termination, trace and account data is deleted in accordance with the retention periods in our Privacy Policy. Sections 4, 7, 8, 10, and 11 survive termination.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands.
The courts of Rotterdam, Netherlands have exclusive jurisdiction over disputes arising from or related to these Terms or the Service, subject to mandatory consumer-protection rules of your country of residence (Article 17-19 Regulation (EU) 1215/2012). If you are a consumer, you may also bring proceedings before the courts of your country of residence, and the Company may only sue you in those courts.
The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We do not commit to using ODR but will cooperate where required by applicable law.
11. Changes
We may update these Terms. Material changes are posted with a new "Last updated" date at the top of this page. Continued use of the Service after the effective date constitutes acceptance. For paid subscribers, we will give reasonable advance notice of material changes.
